Terms of Use
Stack Technology LLC (“Stack”, “we”, “us”, “our”) is a company registered in the Dubai International Financial Centre (“DIFC”), United Arab Emirates. These Terms of Use (“Terms”) govern your access to and use of our website and any services, content, or features we make available through it (together, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Relationship to our service agreements
These Terms govern use of our website. Your use of the Stack point-of-sale platform and related services (the “Services”) is governed by a separate written agreement between you and Stack (for example, a pilot agreement or sales agreement).
- If you have signed an agreement with Stack for the Services, that agreement governs the Services and prevails over these Terms to the extent of any conflict.
- If you use the Services without a signed agreement (for example, under a free or complimentary pilot license), these Terms - together with any acceptable-use rules we give you - govern that use until a written agreement is in place.
2. Who may use the Site
The Site is intended for businesses and for individuals acting on their behalf. By using it, you confirm you are at least 18 years old and able to enter into these Terms. The Site is not directed to children.
3. Acceptable use
You agree not to:
- use the Site in breach of any law, regulation, or third-party right;
- access, tamper with, or disrupt the Site, its security, or its underlying systems;
- attempt to gain unauthorized access to any account, server, or network;
- copy, scrape, reverse-engineer, or create derivative works from the Site or its content, except as expressly permitted;
- use the Site to build or train a competing product or service; or
- misuse the Site in any way that could harm Stack, other users, or the public.
We may suspend or restrict access if we reasonably believe you have breached these Terms.
4. Demo requests and enquiries
If you submit a demo request, contact form, or other enquiry, you agree to provide accurate information and you consent to us contacting you about Stack and the Services. We handle the personal data you submit in line with our Privacy Policy.
5. Automated features and AI-assisted outputs
Parts of the Site and the Services may use automation and artificial intelligence to generate responses, suggestions, or actions (“Automated Outputs”). You acknowledge that:
- Automated Outputs are provided to assist you and may be incomplete, inaccurate, or not suitable for a particular purpose;
- you are responsible for reviewing Automated Outputs before relying on them or allowing them to take effect in your operations; and
- Stack does not warrant that Automated Outputs will be error-free, and your use of them is at your own discretion and risk.
Where automated features can take actions within the Services, the terms governing those actions are set out in your service agreement.
6. Intellectual property
The Site and its content - including text, graphics, logos, software, and design - are owned by Stack or its licensors and are protected by intellectual property laws. The “Stack” name and logo are our trademarks; you may not use them without our prior written permission.
We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Site for its intended purpose. All rights we do not expressly grant are reserved.
If you send us feedback or suggestions, we may use them freely without obligation to you.
7. Third-party links and services
The Site may link to third-party websites or services we do not control. We provide these links for convenience only and are not responsible for the content, products, or practices of third parties. Your use of them is subject to their own terms.
8. Disclaimers
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
9. Limitation of liability
To the fullest extent permitted by law:
- Stack is not liable for any indirect, incidental, special, or consequential losses, or for any loss of profits, revenue, data, or business, arising from your use of the Site; and
- Stack’s total liability arising from or relating to the Site is limited to USD 100.
Nothing in these Terms limits liability for fraud, willful misconduct, or anything that cannot be limited by law. These limits do not affect the liability provisions in any signed service agreement, which govern the Services.
10. Indemnity
You agree to cover us for reasonable losses and costs arising from your breach of these Terms, your misuse of the Site, or your breach of the law or a third party’s rights.
11. Changes to the Site and these Terms
We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Site after an update means you accept the revised Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Dubai International Financial Centre (DIFC). The DIFC Courts have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Site.
